Nshape Privacy Policy 

 

  • This privacy policy sets out how Nshape uses and protects the information that you provide us with when you use this app
  • Nshape is committed to use your data only for the purpose of measuring the application performance and not in a form that identifies you and in accordance with the terms set out within this privacy policy.
  • We collect personal information such as Your name ,Your age ,Your physical composition, Your contact information including email address and phone number ,Demographic information such as postcode, preferences and interests ,Other information relevant to customer surveys and/or promotions. You are free not to share the optional required data knowing that it will restrict your ability to use the app services 
  • Nshape may use collected personal data for purposes of analyzing usage of the Services, providing customer and technical support, managing and providing Services (including managing advertisement serving) and to  develop the Nshape Services products. Nshape may combine non-personal data with personal data.
  • You provide us with information about yourself when you register for the Services, such as your name, email address, gender, age, physical composition and preferences. You may also volunteer to provide additional information in the course of your use of the Services such as height, personal habits, meal details, and program progress. You can choose not to provide any information requested of you with certainty. However, this may limit your ability to use the Services. If you communicate with us by email, we may retain the contents of your messages, your email address, and our responses to you. When you post content (text, images, messages, comments, or any other type of content other than your email address) to our Services, the information contained in your posts will be stored on our servers and may be seen by other users.
  • Please note that certain features of the Services may be able to connect to your social networking sites to obtain additional information about you. In such cases, Nshape may be able to collect certain information from your social networking profile when your social networking site permits it, and when you consent to allow your social networking site to make that information available to Nshape. This information may include, but is not limited to, your name, profile picture, gender, user ID, email address, your country, your language, your time zone, the organizations and links on your profile page, the names and profile pictures of your social networking site “friends” and other information you have included in your social networking site profile. Nshape may associate and/or combine as well as use information collected by Nshape and/or obtained through such social networking sites in accordance with this Privacy Policy.
  • Please refer to your social networking privacy settings to determine how to set your permissions and manage interaction between the Services and your social network account or mobile device.
  • You can, of course, refuse to provide any personally identifiable information through the Company, in which case the Company may not be able to provide some services to you. You can change some personal information in your account by going to “Settings” and modifying your account or by sending an email request at Help@nshape.app You can request that we delete your personal information and we will do our best to fulfill your request, but please be aware that we may be required to keep such Information and not to delete it (or keep this information for a specified time, in which case we will comply with your request to delete only after meeting these requirements). When we delete any information, it will be deleted from the active database, but will remain in our archive. We may also retain your information for fraud and similar purposes. Additionally, if you cancel your account, we may retain some information about you but will remove your profile from the Services.
  • You can stop all information collection by the application by uninstalling the application. You may use standard uninstall procedures that may be available as part of your mobile device or via the app store or network.
  • If you subscribe to any of our subscriptions, or make any purchases through the Services, credit or debit card information (such as card type and expiration date) and other physical data we need to process your payment may be collected and stored by us and/or by our payment gateway who we work with. We may also collect certain limited information, such as your mobile phone number and details of your transaction history, all of which are necessary to provide the Services. Additionally, Payment gateway usually provides us with some limited information about you, such as a unique OTP that enables you to make additional purchases using the information you have saved, your card type, expiration date, and some numbers from your card number.

Disclosure and Transfer of Personal Data

  • Nshape collects and processes personal data on a voluntary basis and it is not in the business of selling your personal data to third parties. Personal data may, however, occasionally be disclosed in accordance with applicable legislation and this Privacy Policy. Additionally, Nshape may disclose personal data to its parent companies and its subsidiaries in accordance with this Privacy Policy.

 

  • Nshape may hire agents and contractors to collect and process personal data on Nshape’s behalf and in such cases such agents and contractors will be instructed to comply with our Privacy Policy and to use personal data only for the purposes for which the third party has been engaged by Nshape. These agents and contractors may not use your personal data for their own marketing purposes. Nshape may use third party service providers such as credit card processors, e-mail service providers, customer services agents, data analyzers and business intelligence providers. Nshape has the right to share your personal data as necessary for the aforementioned third parties to provide their services for Nshape. Nshape is not liable for the acts and omissions of these third parties, except as provided by mandatory law.
  • Nshape may disclose your personal data to third parties as required by law enforcement or other government officials in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose you or Nshape to legal liability. Nshape may also disclose your personal data to third parties when Nshape has a reason to believe that a disclosure is necessary to address potential or actual injury or interference with Nshape’s rights, property, operations, users or others who may be harmed or may suffer loss or damage, or Nshape believes that such disclosure is necessary to protect Nshape’s rights, combat fraud and/or comply with a judicial proceeding, court order, or legal process served on Nshape. To the extent permitted by applicable law, Nshape will make reasonable efforts to notify you of such disclosure through Nshape’s website or in another reasonable manner.
  • We may disclose your personal information to third parties if required to do so by law or a subpoena or if we believe such action is necessary to  comply with the law, comply with legal process applicable to us or our affiliates, or to investigate illegal activities “Actual or suspected” , or to prevent or to take action towards them .Also to to enforce our Terms of Use, to take precautions against liability, to investigate and defend ourselves against any claims from third parties, to assist government enforcement agencies, or to protect the security or credibility of our Site. In addition to performing and protecting the rights, the property, or the  security of the Company, or otherwise act in the interest of our users or others.

 

Objectionable Content  Policy:

  • Nshape Maintains a zero tolerance policy regarding any objectionable content .
  • Objectionable content includes but not limited for : 
  • Sexually explicit material 
  • Obscene ,defamatory,libelous, slanderous,and/or an unlawful  content or profanity 
  • Content that infringes upon the rights of any third party including copyright,trademark,privacy,publicity, or any other personal prosperity right or that is deceptive or fraudulent; content that promotes the use or sale of illegal or regulated substances , tobacco products,ammunition or/and firearms
  • Gambling including without limitation any online casino , sport books ,bingo or poker .
  • Any User can flag content they deem objectionable for review by pressing a “Report” Button or and reporting the content by sending an email to  Help@nshape.app or contacting the customer service through Nshape Chatbot 
  • Any User can report another user due to and not limited to  the above reasons in addition to harassment ,by sending an email to  Help@nshape.app or contacting the customer service through Nshape Chatbot.
  • Nshape will review the content/the raised complaint  and respond within 24 hours.
  • User accounts which have been confirmed responsible for posting objectionable content may be suspended or permanently disable from access to our services and products or delete their accounts. We may also disable or delete the account if the user repeatedly infringe other people’s intellectual property rights or where we are required to do so for legal reasons



Safeguards

  • Nshape follows generally accepted industry standards and maintains reasonable safeguards to attempt to ensure the security, integrity and privacy of the information in Nshape’s possession. Only those persons with a need to process your personal data in connection with the fulfillment of their tasks in accordance with the purposes of this Privacy Policy and for the purposes of performing technical maintenance, have access to your personal data in Nshape’s possession. Personal data collected by Nshape is stored in secure operating environments that are not available to the public. To prevent unauthorized on-line access to personal data, Nshape maintains personal data behind a firewall-protected server. However, no system can be 100% secure and there is the possibility that despite Nshape’s reasonable efforts, there could be unauthorized access to your personal data. By using the Services, you assume the risk
  • In case that personal information is compromised as a result of a breach of security, the Company will promptly notify the individuals whose information has been compromised in accordance with the notification procedures described in the Privacy Policy, or as required by applicable law.
  • Please be aware of the open nature of certain social networking and other open features of the Services Nshape may make available to you. You may choose to disclose data about yourself in the course of contributing user generated content to the Services. Any data that you disclose chats  is public information, and there is no expectation of privacy or confidentiality. Nshape is not responsible for any personal data you choose to make public .
  • If you are under 15 years of age or a minor in your country of residence, please ask your legal guardian’s permission to use or access the Services. Nshape takes children’s privacy seriously, and encourages parents and/or guardians to play an active role in their children’s online experience at all times. Nshape does not knowingly collect any personal information from children below the aforementioned age and if Nshape learns that Nshape has inadvertently gathered personal data from children under the aforementioned age, Nshape will take reasonable measures to promptly erase such personal data from Nshape’s records.
  • Nshape regularly reviews its compliance with this Privacy Policy. If Nshape receives a formal written complaint from you, it is Nshape’s policy to attempt to contact you directly to address any of your concerns. We  will cooperate with the appropriate governmental authorities, including data protection authorities, to resolve any complaints regarding the collection, use, transfer or disclosure of personal data that cannot be amicably resolved between you and Nshape.

    • We use 3rd party services in our apps. These services collect usage data in compliance with their Privacy Policies. The services are described below.

3rd party ad serving systems allow user data to be utilized for advertising communication purposes displayed in the form of banners and other advertisements on Nshape app, possibly based on user interests.


  • Google Analytics

 

Google Analytics is an analysis service provided by Google Inc. Google utilizes the collected data to track and examine the use of Nshape Apps, to prepare reports on user activities and share them with other Google services. Google may use the data to contextualize and personalize the ads of its own advertising network. (http://www.google.com/intl/en/policies/privacy/)

Location information:

  •  We may collect your unique device identifier number if you use our Services on your mobile device, including using the App. If you tell us your location (for example, by allowing your mobile device to send us your location), we may store and use that information to provide you with location-based information and advertising. If you want to disable this feature, you can disable GPS on your mobile device.

 

  • We use the information we collect from you to operate, maintain, and provide features and functionality of the Services to you. In general, we use collected information to communicate with you, respond to your requests, personalize content, improve our products and services, protect your rights and ours, and to comply with laws and regulations. By providing the Company with your email address, you consent to our use of your email address to send you service-related notices, including notices required by law in lieu of communication by post. We may also use your email address to send you other messages, such as newsletters, changes to features of the Services, or special offers. If you do not want to receive emails, you can cancel by sending an email via Help@nshape.app  with the word “No emails” in the subject field. Canceling may prevent you from receiving emails regarding updates, improvements or offers.
  • Nshape may use certain information about you and/or your User Content without identifying you as an individual to third parties. We do this for purposes such as analyzing how the Services are used, diagnosing problems with the Services or technical problems, maintaining security, personalizing ads and offers, and improving our Services.
  • Nshape reserves the right, but is not obligated, to monitor User Content that you post to the Services. It has the right to remove any such information or material for any or no reason, including but not limited to, whether such information or material violates, or may violate any applicable laws or our Terms of Use, or to protect its rights or property or those of any third party or for its defense purposes. Nshape also reserves the right to remove the information at the request of any third party.
  • We may use information collected through logs to  remember information so that you do not have to re-enter it during your visit or the next time you visit the Services, provide personalized content and information,to monitor the effectiveness of our Services , monitoring aggregate metrics such as total number of visitors and traffic, diagnose or fix technology problems reported by our users or engineers ,help you access your information effectively after logging in & finally improve services.
  • Any personal information or content that you voluntarily disclose for posting on the Services (for example, in User Content that you post) becomes publicly available. If you remove your User Content, some copies may remain viewable on cached or archived pages or if other users have copied or stored your User Content.
  • Except the provided in this Policy, the Company will not rent or sell your personally identifiable information to others without your express consent. The Company may share your personally identifiable information with third parties for the purposes of providing the Services to you. If we do this, those third parties’ use of your information will be restricted by restrictions consistent with this Privacy Policy. We may store personal information at locations outside the Company’s direct control (for example, on servers or databases shared with hosting providers).
  • We may purchase or sell assets or business offerings in the process of developing our business. Customer and visitor information is usually a business asset that is transferred in this type of transaction. We may also share such information with any affiliated entity (such as a parent company or subsidiary) and may transfer such information in the context of a corporate liquidation, merger, acquisition or divestiture.
  • The Services may enable you to post content to social networking sites (such as Facebook). If you choose to do so, we will provide the information to these social media sites in accordance with your choices. You acknowledge and agree that you are solely responsible for your use of such websites and that it is your responsibility to review the terms of use and privacy policy of the third parties that provide such websites. We will not be responsible for the availability or accuracy of such networks, the content, products or services offered on or available on such networks , and  Your use of any such network.
  • We are not responsible for the practices employed by websites linked to our Services nor for the information or content contained therein. Please remember that when you use a link to switch from our Services to another website, our Privacy Policy is not in effect. Your browsing and interaction on any other website, including those that have a link on our Website, is subject to that website’s rules and policies. Please read these rules and policies before continuing.

 

  • It is our policy to give notices, whether such notices are required by law or for marketing or other business purposes, through email notification, hard copy or written notice, or by posting such notice clearly on our application; At the company’s own discretion. You reserve the right to determine the form and method of notification to be sent to you, although you may choose to opt out of certain notifications as described in the Privacy Policy.
